The unofficial English version of the GCC Unified Agreement on Value Added Tax (GCC UAVAT) has been released, following the publication of the Arabic version in the Saudi Official Gazette. The GCC UAVAT establishes a framework for Value Added Tax (VAT) across all six member states of the GCC. However, details regarding free zones and a list of exempted edibles are still pending. The agreement emphasizes the importance of fostering economic integration among GCC states through a “unified legal framework” for VAT.

Similar to global VAT systems, the GCC UAVAT provides guidelines for long-term business contracts, addressing the application of VAT to both previously produced materials and those produced in the future. While each member state will implement its own VAT laws and regulations, the overarching framework ensures consistency across the region.

Referred to as the “local law,” the GCC UAVAT is more harmonized than expected, underscoring the significance of cooperation among GCC states. It highlights the importance of the “Common Customs Law” and the “Ministerial Committee” (specifically, the Financial and Economic Cooperation Committee of GCC Member States). This committee is responsible for addressing issues related to the implementation, registration, and amendments of the agreement, with resolutions requiring approval from all member states. The agreement reflects a strong commitment to unity and stability across the GCC.

The GCC UAVAT places strong emphasis on adapting to the digital age by implementing a VAT system designed to be seamless. Each GCC Member State is required to establish an “Electronic Services System” to facilitate this process. During her visit to the UAE in February, Christine Lagarde, the Managing Director of the IMF, stressed that for the GCC UAVAT to thrive, the system must be user-friendly. The electronic system should be robust, capable of generating accurate records for every transaction step.

GCC Member States are responsible for defining tax periods, filing returns, processing refunds, and handling payments, all of which can be managed online. They also have the right to appeal and object to tax rulings. Additionally, they will hold jurisdiction over sectors like education, health, weather, and real estate, with the exception of the local transport sector, which will remain exempt. We await further clarifications on these regulations.
